TERMS and CONDITIONS


These Terms and Conditions govern your use of the mobile application and services provided by PolyU WellMind GO and are only available in English.

 

Background

PolyU WellMind GO (or hereinafter “the application”) is a dedicated mobile game application that is open for current PolyU students (or hereinafter the “users”), who are eligible to download and install it on their mobile phones. The application serves the purpose of promoting knowledge about mental health and relaxation exercises through in-game activities recommending CWS (Counselling and Wellness Section, SAO) wellness programmes.

Users can make use of the application to gain and use virtual credits in the name of “Wellnergy Coin” (or hereinafter the “coin(s)”). Upon performing and fulfilling certain specified tasks and exercises in the application, users will be able to earn Wellnergy Coin(s) which they can accumulate. The Wellnergy Coin(s) earned can be redeemed for gift(s). All coin-crediting and redemption activities must be executed via the PolyU WellMind GO.

 

General Conditions

  • PolyU, the developers and the management team of the application (or hereinafter “we”) reserve the right to change and modify the application, its scope, its operation, its offers, its content, the web page (s) and related publicity of the application, its service, its system structure, and other features, including these Terms and Conditions, or to terminate the redemption and related activities, at any time and without prior notice. By downloading, using, and accessing the application and related services in any manner, users agree to observe and be bound by these Terms and Conditions referenced herein.
  • Although we will use reasonable efforts to notify users of changes to the application, Wellnergy Coin operation and/or to these Terms and Conditions, it is the responsibility of users to keep themselves up to date in respect of the application and these Terms and Conditions. Users understand and agree that all changes to the Terms and Conditions and other information governing the application and Wellnergy Coin operation are effective when they are posted on the website or when they are shown on the application.
  • Duration of the redemption, all the content related to the application, and any of its development and enhancement phases are all subject to change without prior notice.
  • We have the absolute discretion to make the final decision if any dispute arises.
  • Users agree to download the PolyU WellMind GO and agree to assume full responsibility for any damage caused to their devices, any programmes, data or information related to or arising from such download.
  • Users shall not copy, decompile, disassemble, attempt to derive the source codes of, decrypt, interfere with, make any modification or adaptation, or disrupt the integrity or the performance of PolyU WellMind GO. Users shall not use the PolyU WellMind GO for any purpose for which it is not designed or intended.
  • PolyU and/or any developers of the application will not be liable for loss or damage resulting from any amendment to the application itself, the redemption campaign(s), its platform or these Terms and Conditions.
  • Unless otherwise indicated, the content found on the PolyU WellMind GO and its website are subject to copyright owned by PolyU.
  • To ensure that users could have a fair playing experience, users shall not use any cheating actions, glitches or bugs to gain unfair advantages in any activities related to the application. We reserve the right to take any necessary actions in resolving such issues without prior notice to users.
  • Users are recommended to enable “Notifications” on their mobile device in receiving push notifications successfully.
  • The application does not provide official and formal healthcare, medical and counselling functions/services. Any content or resources in the application are for general information and educational purposes only. All the content in the application shall not be considered as a substitute for professional and medical help.
  • It is the responsibility of the users for any considerations, decisions, actions, and outcomes arising by experiencing the application. We are not liable or responsible for those considerations, decisions, actions, and outcomes.

 

Emergency

  • It is suggested that in case of emergency and when there is an imminent risk to the safety of the users (students) or others, please call the 24-hour emergency campus security service at (852) 2766 7999, or the police at 999 for immediate assistance.

 

Eligibility to use

  • By its launch, PolyU WellMind GO is open for current PolyU students. They can download, install and use PolyU WellMind GO which is subjected to successful login with their personal NetIDs and passwords. Misuse of the application, its services or the coin(s) may result in termination or suspension of eligibility to use.
  • Students as users need to log in to the PolyU WellMind GO using their current personal NetID information. They are responsible for the security of their personal information and passwords, and we shall not be liable in the event that a user’s information or password is disclosed, whether intentionally or not, so as to allow a third person access to the user’s account.
  • Students are not required to perform any off-line application before downloading, accessing, and using the application.
  • PolyU WellMind GO management/operation/development team members are eligible to access and use the PolyU WellMind GO and perform responsibilities such as maintaining its normal operation, further development, service enhancement, and investigation of technical issues. They are prohibited from activities involving deliberate and abusive actions to intervene and disrupt the operation, stability, and performance of the PolyU WellMind GO. They are prohibited from any unlawful use of the application or with dishonest intent to manipulate the credit-earning and redemption activities.

 

Download the PolyU WellMind GO

  • PolyU WellMind GO is available on App Store and Google Play. By downloading and installing the PolyU WellMind GO on the users’ mobile phones, users agree to observe and be bound by its Terms and Conditions.
  • PolyU WellMind GO operates all in-app coin-crediting and redemption activities electronically. No print-out records will be provided.
  • As users, students need to log in with their personal NetID information in order to launch and run the PolyU WellMind GO.
  • Users are suggested to maintain the PolyU WellMind GO on one device only. They are suggested not to access and use the mobile application on multiple mobile devices concurrently using the same NetID.
  • Users should check regularly on application updates and new releases.
  • In case the user changes to use another mobile device or has lost his/her device with the PolyU WellMind GO previously installed, the user can download and install the PolyU WellMind GO onto his/her new device, and log in to run it with the same NetID.
  • By downloading and installing the PolyU WellMind GO, users agree not to copy, reproduce, alter, modify, create derivative works, or broadcast any content, programmes, and codes from the PolyU WellMind GO.
  • The application may at times prompt users to re-login for security purposes. Users can log in again to continue using the application.

 

Earn Coins

  • Users can earn Wellnergy Coin(s) through different acts, including (i) daily check-in at “mood diary” (ii) completing the in-game activities and (iii) joining designated events and wellness activities.
  • Users should read the EARN COINS and ANNOUNCEMENTS sections of the PolyU WellMind GO website carefully for information about the channels and the mechanism for earning Wellnergy Coin(s) as well as all guiding PolyU WellMind GO Terms and Conditions. They can also check the corresponding information on the PolyU WellMind GO as well.
  • Users will be given five (5) Wellnergy Coins upon the first-time installation and first-time use of the PolyU WellMind GO as an incentive.
  • Users will be given one (1) Wellnergy Coin after completing the daily check-in activity.
  • Users who complete the daily check-in on both the consecutive 10th and 20th days of each month will receive an additional five (5) coins.
  • PolyU and/or the management team may run promotions, campaigns, events and wellness activities from time to time offering Wellnergy Coin(s) and/or bonus Wellnergy Coin(s). The scope and details of these promotions, campaigns, events, and activities are subject to change at any time without prior notice.
  • The Wellnergy Coin(s) would expire annually by 30th June.
  • Users should make use of the PolyU WellMind GO that runs on their mobile phones to earn and accumulate Wellnergy Coin(s), and follow the guidelines on the PolyU WellMind GO for any coin-earning activities and gift redemption activities.
  • It may take immediate effect for Wellnergy Coin(s) to be credited to the user’s account in the PolyU WellMind GO. The PolyU WellMind GO server will be the official clock.
  • The amount of the Wellnergy Coin(s) shown on the main page of the application shall be the final and unquestionable amount.
  • We have the absolute discretion to make the final decision if any dispute about the Wellnergy Coin(s) arises.
  • Users can use the PolyU WellMind GO to check the balance of their Wellnergy Coin(s).
  • Unspent Wellnergy Coin(s) will reset to zero at 00:00 on every 1st July. We reserve the right to adjust the validity/expiry of the Wellnergy Coin(s) from time to time and will make announcements and communicate with users.
  • Users may need to relaunch or restart the PolyU WellMind GO from time to time to validate the activities and transactions they made on the PolyU WellMind GO, including but not limited to crediting the Wellnergy Coin(s), checking the Wellnergy Coin(s) balance, checking updates in the ANNOUNCEMENTS section, etc.
  • The Wellnergy Coin(s) have no cash or other value and may not be sold, bartered, traded or otherwise transferred.

 

Use Coins

  • Wellnergy Coins are valid for converting to redeeming gift(s) as soon as they are credited to the user’s account on the PolyU WellMind GO. Wellnergy Coin(s) will be maintained in the users’ PolyU WellMind GO and will be deducted when users decide to convert Wellnergy Coins to available gift(s) under “My Coupon”. Users should follow the instructions on the PolyU WellMind GO, select the gift(s) they want, and click ‘Redeem’ to convert Wellnergy Coins to gift(s) for use.
  • The quantity of Wellnergy Coins required to convert to available gift(s) vary per campaign and each offer. Users should read carefully the PolyU WellMind GO Terms and Conditions and guidelines to redeem Wellnergy Coins for gift(s) in advance.
  • The redemption of the gift(s) will be valid for a one-time use within seven (7) days after the users click ‘Redeem’. If users do not redeem and get the gift(s) within seven (7) days after clicking the “Redeem”, the redemption would be cancelled and the quota of the gift(s) would be released. The coins used for the redemption will be voided.
  • All Wellnergy Coins required for the redemption of gift(s) must be earned by the same user under the same NetID.
  • The users should present the redeemed gift(s) in the form of a QR code via the PolyU WellMind GO for scanning by the staff.
  • It is the users’ responsibility to present the correct QR code for scanning by the staff. Once scanned, the gift(s) is/are considered ‘redeemed’ and will not be re-issued or refunded.
  • The gift(s) is/are mainly for encouraging users to experience and learn from the application. Hence, the gift(s) is/are mainly for the user’s personal use and we encourage that the gift(s) is/are not be used for selling to others.
  • Redeeming Wellnergy Coins is subject to a first-come-first-served basis while stocks last.
  • The quantity of the gift(s) and the redemption activities are based on the actual stocks. The stocks shown on the website are for reference only.
  • The gift(s) cannot be exchanged for cash or other offers. They will not be re-issued in case of loss due to any technical problems.
  • Specific Terms and Conditions of the gift(s) apply and users should refer to and check the details in advance.
  • Details and expiry of the gift(s) and their conditions of use are subject to change at any time without prior notice.
  • We reserve the right to adjust or cancel any Wellnergy Coin(s) credited to a user’s account or redeemed incorrectly, or not in accordance with, or in breach of, these PolyU WellMind GO Terms and Conditions at any time, with or without notice to the user.
  • We are not responsible for any further usage of the gift(s) after successful redemption. In case of doubt, the users should contact the operator(s)/supplier(s) who offer these gift(s).
  • The gift(s) may have their own expiration dates, terms of use, and specific details that require attention. It is the sole responsibility of the users to be aware of and comply with those regulations and information.
  • We are not responsible for any loss or damage caused by or resulting from the content or the gift(s) itself/themselves, and we do not accept liability for such losses or damages.
  • All the QR codes leading to deducting the coin(s) and redeeming the gift(s) are valid for one-time use/scanning only.

 

Technical requirements

In order to access the PolyU WellMind GO platform electronically, users need an Internet-connected mobile device compatible with iOS® 10 and above or with AndroidTM 13 and above.


Personal data collection and Privacy Policy Statement

  • PolyU WellMind GO management / operation / development team pledge to comply with the requirements of the Personal Data (Privacy) Ordinance. You may refer to the Personal Information Collection Statement here.
  • By downloading, using, and accessing the application and related services in any manner, users allow PolyU WellMind GO management / operation / development team to use their information of mobile application record for the purposes of (i) the administration of the application; (ii) communication between PolyU and the users; (iii) collection of opinions; and (iv) statistical and analytical purposes. It may be disclosed to other departments or units within the University for one or more of the purposes specified above. We will not disclose users’ personal data to any external body or organisation unless users’ consent is sought, and it will not be used for any other commercial purpose.

 

  • In case of ad-hoc campaigns and promotions, users may choose to give their personal information online on a voluntary basis.

 

  • We may run publicity event(s) in association with Wellnergy Coin. We may take photographs/ video recordings during the event(s) and use such images in publicity or marketing activities. The recorded images will be handled according to the prevailing policy of The Hong Kong Polytechnic University. Enquiries shall be addressed to stud.counselling@polyu.edu.hk by email.


Third-Party Content

PolyU WellMind GO may display third-party content, links, promotions, logos and other materials on or through the PolyU WellMind GO (collectively, “Third-Party Content”). We do not control, endorse, sponsor or adopt any Third-Party Content or any third parties referenced on the mobile application, and make no representations or warranties of any kind regarding such Third-Party Content, including, without limitation, regarding its accuracy or completeness. Users’ interactions with Third-Party Content, and any third party that provides Third-Party Content, are solely between the users and such third parties, and we are not responsible or liable in any manner for such interactions or Third-Party Content.


Third-Party Offers and Functionalities

PolyU WellMind GO may partner with external parties to introduce offers and other functionalities to users from time to time. We do not control and will not accept any liability, obligation or responsibility whatsoever for any loss or damage arising from or in respect of any use or misuse or reliance on such offer or functionalities.

  • Unless otherwise indicated, all the content found on the PolyU WellMind GO and its website are subject to copyright owned by PolyU.
  • The content of the PolyU WellMind GO and its website will be updated from time to time without notice.
  • The information on PolyU WellMind GO and its website is provided to users on an "AS IS" basis without any express or implied warranty of any kind and is provided for a general, indicative purpose only. We do not make any express or implied warranty as to the accuracy, fitness for a particular purpose, non-infringement, reliability, security, timeliness or freedom from computer viruses in relation to such contents. We will not be liable for any errors in, omissions from, or misstatements or misrepresentations (whether express or implied) concerning any such information, and will not have or accept any liability, obligation or responsibility whatsoever for any loss, destruction or damage however arising from or in respect of any use or misuse of or reliance on the information delivered on the PolyU WellMind GO and its website, or inability to use the PolyU WellMind GO or its website.


Disclaimer

  • Users will indemnify and hold harmless PolyU from and against any and all actions, claims, proceedings, damages, losses, costs and expenses resulting from: (a) use of the PolyU WellMind GO; (b) any use of NetID information; (c) users’ breach of these PolyU WellMind GO Terms and Conditions; (d) users’ breach of any statutory requirement, duty or law; or (e) users’ violation of any rights of another person or entity.
  • We do not represent or warrant that: (a) the use of the PolyU WellMind GO will be secure, timely, uninterrupted or error-free or that they will be compatible or operate in combination with any other hardware, software, system or data; (b) the content on application will meet users’ requirements or expectations; (c) errors or defects in-app will be corrected; (d) the application is free of viruses or other harmful components; or (e) the availability period of the application.
  • We do not warrant that the PolyU WellMind GO will be compatible or interoperable with users’ devices or any other piece of hardware, software, equipment or device installed on or used in connection with their devices. The PolyU WellMind GO may be subject to limitations, delays, and other problems inherent in the use of the Internet and electronic communications (including problems inherent to the computer or electronic device they use). We are not responsible for any delays, damages, or losses resulting from such problems.
  • We will not have or accept any liability, obligation or responsibility whatsoever for any loss, destruction or damage however arising from or in respect of any use or misuse of the gift(s) delivered through the PolyU Wellmind GO.

These Terms and Conditions are written in and only available in English. They are subject to further changes and amendments from time to time.
